These Terms & Conditions ("Terms") govern your use of artisticrefinishing.com (the "Site") and your engagement with Artistic Refinishing, Inc. ("we," "us," "our"). By using the Site or engaging us for services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. Who we are

We are a family-owned surface refinishing company serving South Florida since 1994. We refinish bathtubs, showers, tile, countertops, kitchen cabinets, and bathroom vanities — as well as commercial and rental properties — restoring existing surfaces in place instead of replacing them.

2. Using the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. Prohibited uses include:

• Transmitting any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Attempting to gain unauthorized access to the Site, its servers, or any related systems
• Using automated means (bots, scrapers, crawlers) to access the Site except as permitted by our robots.txt

3. Intellectual property

All content on the Site — including text, graphics, logos, photos, and icons — is the property of Artistic Refinishing, Inc. or our licensors, and is protected by United States and international copyright laws. You may view and print pages for personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

4. Service terms

The following terms apply when you engage us for refinishing services:

Estimates and scheduling

• Estimates are free and provided before any work begins. We come to you to assess the project and provide a written, no-obligation quote.
• We will not perform work beyond the approved estimate without your authorization.
• Estimates are valid for 30 days from the date issued, subject to conditions found at the time of service.
• Work is scheduled once you approve the estimate. We confirm all appointments before work begins.

Cancellations

• You may reschedule or cancel at any time before work begins at no charge.

Payment and refunds

• Payment is due upon completion of the work unless other arrangements are made in writing. Accepted payment methods are confirmed at the time of your estimate.
• All sales are final. Because refinishing is a custom service performed on your property, we do not offer refunds, and we do not accept credit-card chargebacks. If you have any concern about completed work, contact us and we will work with you under the warranty terms below.
• Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by Florida law.

Workmanship warranty

• Our work is backed by a workmanship warranty covering chipping and peeling of the finish under normal use. Warranty terms are confirmed at the time of your estimate, and not every service carries a warranty.
• The warranty does not cover damage caused by outside factors or improper care, including but not limited to the use of bath mats or suction-cup mats, abrasive cleaning products, harsh scrubbing, bleach, accident, abuse, neglect, or work performed by other parties.
• We provide simple care instructions on completion, and following them is required to keep the warranty in effect.

5. Limitation of liability

To the fullest extent permitted by law:

• Our liability for any claim arising from service we provide is limited to the amount you paid for that service.
• We are not liable for incidental, special, or consequential damages, including lost profits, loss of use, or inconvenience.
• Nothing in these Terms limits or excludes our liability for gross negligence or willful misconduct, or any liability that cannot be excluded under Florida law.

6. Indemnification

You agree to indemnify and hold harmless Artistic Refinishing, Inc. and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site or our services.

7. Disclaimers

• The Site is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the Site will be uninterrupted, error-free, or secure.
• Any outcome of a refinishing project beyond what is explicitly covered by the workmanship warranty is not guaranteed.

8. Third-party services

The Site integrates with or links to third-party services (such as Google Maps, Google Analytics, and social media). Your use of those services is governed by their own terms and privacy policies.

9. Governing law and dispute resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising from these Terms or our services will first be addressed through good-faith discussion between the parties. If it cannot be resolved through discussion, both parties agree to attempt mediation in Palm Beach County, Florida, before pursuing litigation. Any lawsuit must be filed in the state or federal courts located in Palm Beach County, Florida.

10. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on the Site with a new Effective Date. Your continued use of the Site or engagement of our services after changes take effect constitutes acceptance of the revised Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions remain in full effect.
